JUDGE
DISMISSES APPLICATION CALLING FOR MORE WITNESSES |
The Lesotho
High Court has ruled in favour of respondents in a case of
allocation of seats in Parliament lodged by Marematlou
Freedom Party (MFP) to proceed with points before court.
Judge Semapo Peete said the court has decided to exercise
its discretion to allow respondents to argue the issue of
jurisdiction and other points.
This follows an application lodged by the respondents
opposing the calling of more witnesses and cross-examination
of Mr. Kelebone Maope, who had already given evidence in
court.
Meanwhile, Advocate Molefi Ntlhoki had opposed the
application lodged before court, saying the application was
late as the court was already dealing with the merits of the
dispute.
Advocate Ntlhoki further asked the court to grant him leave
to amend his prayers. He said he wants to submit his
application following the ruling made by the court.
Meanwhile, Judge Peete granted him an opportunity to file
his application which, he said should be ready by next
Wednesday and Advocate Viljoen will be given a chance to
argue the points raised by Advocate Nthloki.
The case has been postponed to give Advocate Ntlhoki chance
to file his application.
Respondents are the Independent Electoral Commission (IEC),
Speaker of the National Assembly, Attorney General and all
parties that participated in the general election.
The case is being presided by judges Semapo Peete, 'Maseshophe
Hlajoane and Lisebo Chaka-Makhooane.
