A defence lawyer in a case in
which a 36 year-old man of Quthing, Molefi Pitiri, is charged with fraud
says the accused paid relevant tax to the Lesotho Revenue Authority (LRA). Advocate Seleke said this on Tuesday when cross examining LRA cashier Mr. Ts'eliso Koloko, who testified that the accused did not pay Value Added Tax (VAT), customs duty and storage fee in respect of his imported vehicle on October 17 last year. Advocate Seleke said if ever the accused did not pay the relevant taxes, his vehicle could have not been released to him from the warehouse, as the vehicle is only released after all payments are made. He added that the accused should not be held liable for fraud committed by the LRA staff, saying the accused needed service from LRA which he was duly given. Advocate Seleke noted that an ordinary public member would not know if the receipt was fraudulent or not, his is to accept any paper given by the official. Pitiri stands trial under the said charge in that he pretended to have paid VAT, customs duty and storage fee to LRA in respect of his imported vehicle. The case is before the magistrate Mr. Ts'eliso Bale, while it is prosecuted by Mr. Mathaba |
