FOR JOINDER |

Maseru, May 29 - A case in which
the Basotholand Congress Party (BCP) members applied for a joinder in a
major case in which some party members demand for the nullity of a 2005
conference, continued in the High Court on Monday. When presenting the case, legal representative for the appellants, Advocate Ts'abo Matooane, said his clients have a right to apply for joinder as the resolutions for the 2005 conference have a direct bearing on them. He explained that, the first applicant, Lerato Makhooane, like other party members were denied a right to participate in a conference that was held in February 2005. Advocate Matooane disclosed that, after the conference, Makhooane who was a member of the executive committee was told that their committee had been disqualified. He clarified that since the applicants were barred from the 2005 BCP conference, the party's constitution was contravened. When counteracting Advocate Matooane's submission, a legal representative for the defendants, Advocate Thulo Mahlakeng, said the applicants did not have a right to lodg such an application, as they were not members of the BCP. ' There is not even a single document they provided the court with, as proof of being the party's members,' he stated. The case that is before Justice Winston Maqutu, is continuing. |
