APPLICATION AGAINST BCP NEC DISMISSED
  Maseru, June 22 - The Lesotho High Court has dismissed application filed by some members of the Basotholand Congress Party (BCP) against the party's executive committee.

The applicants had asked the court to declare the party's annual general conference of January 29 to 30, 2005 that was held at Bambatha Spots Arena, procedurally irregular.

The applicants further asked the court to declare the resolutions thereof null and void, including the executive committee that was held at that conference, which is under the leadership of Mr. Sekoala Toloane.

They asked the court to reinstate the committee, which is led by Mr. Ntsukunyane Mphaya, which is the committee that was elected in 2003.

When dismissing the application, Justice Winston Maqutu said the application was filed in the last 15 months. He said if the application was genuine, the applicants could have pursued it within a reasonable time.

He further said the fact that initial applicants were no longer represented during the trial, he considered their affidavits as mere statements. He was referring to, among others; Moeketsi Tsatsanyane, Nkareng Masike, Habofanoe Matsie and Lebohang Hlaele.

Justice Maqutu said as for two applicants who had just applied for joinder, their application cannot stand and therefore dismissed it.

He also observed that as for the initial applicants, it has never been canvassed as to whether they held any authority from their respective constituencies in order to have the right to sue the executive committee.

The applicants were represented by Advocate Ts'abo Matooane, while the respondents were represented by Advocate Thulo Mahlakeng.
