The lawyer representing some of the accused
in the murder case of former Regional Manager of Precious Garments factory
Mr. Peter Mokheseng has applied for the discharge of two of his clients
because the prosecution has failed to prove their guilt.
Applying for the discharge of Molai Mosoaboli and Nokoli Hloloane in the
High Court on December 8, Advocate Molefi Ntlhoki said although crown
witnesses Malise Malise, Mohlaoli Thupa and Lebohang Mohato were accomplice
witnesses, they failed to incriminate the accused.
Evidence by these witnesses only showed that the two accused made some
utterances that had nothing to do with the death of Mokheseng. Evidence in
court did not show the role that each of the two accused played in the
conspiracy of the planning of the deceased's death.
Mohato told the court that Hloloane was enraged when she heard that
Mokheseng had been murdered and subsequently said she was not a sweet potato
that is eaten. Whatever that meant, it did not associate her with the
offence.
'Mohato even said Hloloane told them that she had fainted when she heard
that the deceased had been killed,' Advocate Nthloki said.
Lesaoana Molomo, Thabiso Mothobi, Bokang Molongoana, Kutoane Kori, Molai
Mosoaboli and Nokoli Hloloane are charged with the murder of Peter Mokheseng
at Qoaling, on March 21, last year.
The case, before, Justice 'M'aseshophe Hlajoane, is continuing.
