| Judge to Rule on Writ of Execution | |

Justice Thamsanqa Nomngcongo will decide on a date to deliver judgment in the case in which a leader of the BAC asked the Court to nullify a writ of execution served on the BAC by the BCP. Dr. Khauhelo Ralitapole, a leader of the Basotholand African Congress, opposed the writ served on her and 15 other members who had been respondents in a case in which they contested the legitimacy of the 2001 BCP National Executive Committee (NEC). A 2004 judgment ordered the BAC to pay the Basotholand Congress Party M24 000 in costs and thus the writ of execution. Although the legal representative of the respondents, Advocate Thulo Mahlakeng, claimed in the BCP’s defence that the writ which was to be effected on Dr Raditapole on behalf of the Basutoland African Congress was not properly executed, it had his signature, said Dr Raditapole’s legal representative Advocate Amohelang Lekalakala. In counter submission, Advocate Mahlakeng said the applicant has come to court pre-maturely, as the writ she brought to court does not bear the Registrar's signature. 01 November 2005 |
