NEW APPEAL COURT JUDGE PROMISES TO MAINTAIN COURT'S HIGH STANDARD

The new Lesotho Appeal Court judge has promised to maintain a high standard that his court has set itself, in dispensing justice to all persons alike, without fear or favour, and with due expedition. Addressing members of the Law Fraternity in the High Court on Wednesday 13 November,2002 after he was sworn in as the Appeal Court judge, Justice Michael Ramolibeli said the Court of Appeal is the only court that has no backlog of cases. He attributed reasons for this, to commitment, dedication, and
resourcefulness of judges of the Court of Appeal in going about their work.

He explained that, he learned a great deal from judges of the Court of Appeal, during a two and a half years in which he worked with them. He said their experience and knowledge of the law could not be matched. Justice Ramolibeli pointed out that, his task would be made easier by the fact that Lesotho has a commendable track record of respect for the independence of the judiciary, which he said is amazing, taking into
account, the country's past political troubles.  " Interference with the independence of the judiciary as is the case in other countries of the world, should be condemned, as it is a threat against democracy and the rule of law, " he said.

He commended the Lesotho government for its wisdom of having Executive, Legislature and the Judiciary, that he said are meant to provide checks and balances so that no single arm of government could become too powerful to the extent of abusing its power to the detriment of others.  " This is a cornerstone for a true democracy and it is as such a very important constitutional principle, which the Appeal Court will uphold, " he specified.

In conclusion, the Appeal Court Judge thanked the law society and all legal practitioners for the support they have given to him over the years both at the Bar and Side Bar, as well as on the bench. He acknowledged that, history would show that he was the first judge that was appointed to the bench on the recommendation of the Law Society of Lesotho. Present at the occasion, included the Chief Justice Mr. Mahapela
Lehohla, judges of the high court, registrars, assistant registrars and lawyers.

Justice Michael Ramolibeli was sworn in as the judge of Appeal Court, while Acting Judge of the High Court Justice 'M'aseshophe Hlajoane was sworn in as the judge of the High Court, during a swearing in ceremony that was held at the Royal Palace Banqueting Hall on Wednesday 13 November,2002.
