MONYAU COMMITTED OFFENCE AND HAD TO BE ARRESTED- LESITSI
  A Lesotho Defence Force (LDF) Officer says the Roman Catholic Priest Father Anthony Thabo Monyau committed a criminal offence, when he said he would arrest the LDF Commander, Lieutenant Makhula Mosakeng on September 4, 1998, and had to be arrested. During cross examination by the Defence Counsel, in the High Court on Thursday 08 August,2002 Colonel Lekate Lesitsi, said the accused committed a criminal offence, because the Commander is one of the important people in the country, whose arrest resembles overthrowing of a government.

He explained that, as much as the Commander is to be arrested if he has committed an offence like any citizen of the country, but it was his right (witness)  to know which offence the Commander had committed. He also said he was not only to be informed about such an offence, but he was to be convinced as well, before such arrest could be effected. Colonel Lesitsi stated that, it is also his right to be informed about a criminal offence that is committed by any member of the LDF, or that such information could alternatively be imparted to the Military Intelligence branch.

" The Military Intelligence could then inform the Commander before such an  offence is reported to the police," he pointed out. In response to Advocate Kananelo Mosito's question of whether there is anywhere in either the constitution of the country, rules and regulations that govern the LDF, or any statute, where these right he had mentioned has been prescribed, the witness said there is no provision in anyone of the pieces of legislations mentioned by the Defence Counsel. Colonel Lesitsi  however clarified that it is a procedural way that the LDF deals with its affairs, that criminal offences committed by the LDF members should not be broached to the police, before the Commander is informed about them.

Father Anthony Thabo Monyau is accused of among charges High Treason, after he allegedly conspired with some members of the LDF to arrest the Commander and some senior LDF officials on September 11 1998. The accused is also reported to have plotted with some members of the LDF to murder the Prime Minister, Mr. Pakalitha Mosisili and the then cabinet ministers during the political riots of 1998 which were quelled by the Southern Africa Development Community (SADC) armed forces.
The case that is before Justice Ts'eliso Monaphathi is continuing. The Prosecutor is Mrs. Pingla Hemraj.
